1 Definitions
1.1 The term “on-line contract of sale” means the purchase agreement relating to movable tangible goods sold by ORUM OCCHIALI, concluded between the same and the Customer as part of a remote sales system via telematics, organized by ORUM OCCHIALI.
1.2 The term “Customer” means the individual consumer that makes the purchase of this contract, for purposes not related to their business or profession.

2 Subject of the Contract
2.1 With this contract, respectively, ORUM OCCHIALI sells and the Customer buys movable goods from a distance through telematics, that were displayed and offered for sale on the site www.anticaocchialeria.com
2.2 The products referred to above are described on the site www.anticaocchialeria.com and in the relevant fact sheets; The pictures of the products may not be fully representative of their features but may differ in color, size and accessories.
2.3 These terms and conditions of sale do not regulate the supply of services or the sale of products made by third parties that use direct links to the site www.anticaocchialeria.com through banners or by other hyperlinks / links. ORUM OCCHIALI can, under no circumstances, be held responsible for the provision of the services promised by third parties, or for the execution of e-commerce transactions between ORUM OCCHIALI customers and a third party.

3 Stipulations and Conclusion of the Contract
3.1 The contract between the Customer and ORUM OCCHIALI is concluded through the Internet by the Customer accessing www.anticaocchialeria.com, where the customer formalizes the proposal for the purchase of goods set out in paragraphs 2.1 and 2.2 of the previous article.
3.2 The purchase contract is concluded by completing the following steps, which can always be corrected, modified, and canceled up until the time of the order: by accessing the website www.anticaocchialeria.com. After registering the purchase, the customer should add any desired products to the shopping cart, complete all subsequent pages, following the instructions, and electronically transmit the page with all personal data and the purchase order to ORUM OCCHIALI; the order page contains a link to these general conditions of sale and also contains information on the key features of each product ordered and its price (including VAT), the type of payment chosen, the conditions for the delivery of the products, the amount required for delivery and transportation, in addition to references to the terms and conditions for the return of products purchased online; before proceeding with sending the order, the Customer will be required to identify and correct any errors that might have occurred during the compilation of the fields, and to carefully read the terms and conditions governing the sale and purchase, print a copy thereof using the print option, and to save or request a copy to save for personal use; an order will be considered sent when ORUM OCCHIALI has received the proposed order electronically, and the order information has been verified as correct.

3.8 Under Article. 12 of Legislative Decree no. 70 of 2003, ORUM OCCHIALI informs the Customer that any order sent is stored in digital or paper form at its headquarters, in accordance with criteria of confidentiality and security. The Customer may at any time request a copy from ORUM OCCHIALI.

4 Payment Methods
4.1 Each payment made by the Customer can only take place through one of the methods listed on the site www.anticaocchialeria.com. Credit cards of the major international circuits, prepaid and rechargeable cards issued by banks in the Italian area are accepted: VISA, MASTERCARD, AMERICAN EXPRESS, POST PAY.
4.2 For payments made by credit card, the actual charge of the order will only take place when it is complete and ready to ship. If the unavailability of a product is detected after the order registration, ORUM OCCHIALI will take the necessary measures with the operator of the payments to reverse the transaction related to any goods not available.
4.3 In order to protect the Customer, all orders are subject to control before being processed directly by the institutions issuing the credit cards. If, for any reason, you can not pay the charged amount due, the sales process will be automatically canceled and the sale will be terminated pursuant to art. 1456 cc. The Customer will be informed via e-mail automatically.

5 Prices
5.1 Prices displayed on the site www.anticaocchialeria.com include VAT and refer only to the products sold online. The price charged will be the one in force at the time of the order and in the email confirmation of the order, regardless of increases or decreases in prices, even for promotions, which may have occurred in the meantime.
5.2 The shipping costs are included in the purchase price and are indicated and calculated at the conclusion of the buying process before payment.
5.3 An official invoice will not be issued unless it is specifically requested by the Customer no later than the moment of the transaction, as indicated in Art. 22 of Presidential Decree of 26/10/1972 n. 633. By sending the order to ORUM OCCHIALI the Customer agrees to receive the invoice / receipt in electronic format. The Customer can receive the invoice / receipt in hard copy upon written request to ORUM OCCHIALI. After the issuance of the invoice, no further changes can be made to the said data.

6 Product Availability
6.1 Product availability refers to the time when the Customer see the product info-sheets; This must still be deemed to be merely indicative because, owing to the presence of multiple users on the site simultaneously, the products could be sold to others before confirming the order. In any case no liability can be attributed to ORUM OCCHIALI in the case of unavailability of one or more products.
6.2 ORUM OCCHIALI will not be in any way responsible for the temporary or permanent unavailability of one or more products. 6.4 For the cases referred to in the previous point, the Customer can choose, at the time of the order, whether to accept a different product from that agreed upon, of the same value.

7 Delivery Methods
7.1 ORUM OCCHIALI will deliver the selected and purchased products by courier to the address specified by the Customer when ordering, as confirmed in the e-mail summary of point 3.3.
7.2 Orders will be processed on receipt. ORUM OCCHIALI strives to deliver its products as quickly as possible and within three days from the date the order was received from the Customer, with the exception of the month of August.
7.3 The total amount of expenditure will be visible before proceeding with the purchase confirmation.
7.4 The delivered goods will be checked and delivered to the shipping company intact and without defects. ORUM OCCHIALI will not be held in any way responsible for any delay or damage attributable to the fault of the shipper.

8 Responsibility
8.1 ORUM OCCHIALI does not assume responsibility for being unable to execute the order within the time stipulated in the contract in the case of disruptions in service caused by force majeure or unforeseeable circumstances, even those resulting from failures and outages of the Internet.
8.2 ORUM OCCHIALI will not be liable for any damages, losses and costs incurred by the Customer as a result of breach of contract for reasons not attributable to the same, and only if they depended on acts or omissions of ORUM OCCHIALI, the customer is entitled to a reimbursal of the price paid and any charges incurred.
8.3 ORUM OCCHIALI can not be held liable for information, data, and any technical or other inaccuracies that may be displayed on the site, if they have been submitted by third parties and have been verified by ORUM OCCHIALI according to the criteria of ordinary diligence.
8.4 ORUM OCCHIALI assumes no responsibility for any fraudulent or illegal use that may be made by third parties of credit cards, cheques, and other means of payment for goods purchased, if it is proven that all possible precautions were taken based on the best science and experience of the moment and according to ordinary care.

9 Return Policy
9.1 The Customer has the right to cancel the contract without penalty, specifying the reason, within 14 working days from the day of receipt of the products, by sending a written notice by registered letter a / r to ORUM OCCHIALI, Via San Gallo 126 / R, Florence, Italy. The communication can be sent, within the same period, by telegram or e-mail (address [email protected] ) provided it is confirmed by registered letter with acknowledgment of receipt within forty-eight hours.
9.2 The communication referred to in the preceding paragraph shall specify the intention to cancel the purchase and the product or products for which it intends to exercise the right of withdrawal, by attaching a copy of the receipt / invoice [of the order confirmation email or bill, where it is requested]. 10 Guarantees and Forms of Assistance
10.1 ORUM OCCHIALI markets eyewear of high quality. In case of receipt of any product not complying with the contract of sale, in accordance with articles 129 et seq. of the Consumer Code, the Customer loses all rights unless the defect is communicated to the seller within a period of two months from the date the defect was discovered. The complaint is not required if the seller has acknowledged the existence of the defect or has concealed it.
10.2 In any case, unless proved otherwise, it is assumed that a defect that becomes apparent within six months of delivery of the goods already existed on that date, unless this presumption is incompatible with the nature of the goods or the nature of the defect.
10.3 In the event of lack of conformity or defect, the Customer can ask, without charge, under the conditions set out below, the repair or replacement of the goods purchased, a reduction in the purchase price, or the termination of this contract, unless the request is objectively impossible to satisfy or it is prohibitively expensive for ORUM OCCHIALI pursuant to art. 130, paragraph 4, of the Consumer Code.
10.4 The request should be sent in writing, by registered mail, to ORUM OCCHIALI, Via San Gallo 126 / R, Florence, Italy, which will indicate their disponibility to act on the request, or the reasons they are unable to do so, within seven working days of receipt. In the same communication, when the Customer’s request has been accepted, ORUM OCCHIALI will indicate the method of delivery or return of the goods, as well as the deadline for the return or replacement of defective goods.
10.5 If repair and replacement are impossible or excessively expensive, or ORUM OCCHIALI has failed to repair or replace the goods within the period referred to in the preceding paragraph or, finally, the replacement or repair carried out previously has caused significant inconvenience to the Customer, an appropriate price reduction or termination of contract may be requested. The Customer will then have to send their request to ORUM OCCHIALI, which will indicate their disponibility to act on the request, or the reasons they are unable to do so, within seven working days of receipt.
10.6 In the same communication, when the customer’s request has been accepted, ORUM OCCHIALI will indicate the price reduction proposal or how to return the defective goods. In these cases it is the responsibility of the Customer to indicate how to refund the amount previously paid to ORUM OCCHIALI.

11 Customer Obligations
11.1 The Customer agrees to pay the price of the goods purchased in the time and manner specified by these Conditions of Sale.
11.2 Once the purchase process online has been concluded, The Customer agrees to print and conserve these Conditions of Sale, which were expressly accepted before the conclusion of the procedure.
